Important Decision in VS v KS on Stay and the Appropriate Forum for Divorce

Charles Hale KC has acted for the successful respondent in VS v KS [2023] EWHC 3475 (Fam). This is an important decision on stay, and the appropriate forum for divorce and financial applications.
The court determined that the wife would obtain substantial justice in Monaco, where the proceedings had been up and running for 7 months before the wife issued proceedings in London based on her habitual residence.
