The application to appeal the High Court decision to the Court of Appeal is also refused.
Cliona Papazian instructed by Freemans Solicitors and Ruth Kirby instructed by Dawson Cornwell Solicitors appeared in the case Re A (A Child) (Inherent Jurisdiction: Parens Patriae, FMPO and Passport Orders), where the High Court acceded to an application to use a child’s British nationality to order her return to this jurisdiction from Algeria.
The application was made by a mother who had not seen her daughter for 12 years due to past domestic violence against her by the child’s father and recent violence against the child.
An application was made on behalf of the father for permission to appeal to the Court of Appeal. The application was refused.
