A mother who was found to have been one of two adults who could have caused a physical injury to her son had been denied a fair trial and an opportunity to meet the case against her where a judge had introduced the possibility that she was in the pool of potential perpetrators only after all evidence had been heard and submissions made. That was a serious procedural irregularity which had fatally compromised the fairness of a finding of fact hearing.
