David Williams QC and Ruth Kirby will be speaking at a seminar with Blake Morgan LLP examining the crossover of the family and immigration jurisdictions.
The frequency of immigration issues within family law has significantly increased in the last few years and family lawyers are increasingly having to grapple with the complex immigration system. Likewise, since the introduction of s.55 of the Borders, Citizenship and Immigration Act 2009, immigration practitioners have to deploy unfamiliar family law concepts and principles.
Despite the increasing crossover between the jurisdictions, and even a joint practice direction from the Presidents of the Family Division and the Immigration and Asylum Chamber, knowledge and procedure is not being shared and we are in danger of returning to the days of little co-operation.
The seminar will benefit both family and immigration practitioners.

David will speak on the jurisprudence surrounding Article 3.1 and Article 12 of the Convention on the Rights of the Child, including the seminal Supreme Court decision of ZH (Tanzania). |
| 6.30 pm – 6.50 pm | Ruth Kirby, 4 Paper Buildings
Ruth will give an overview of the family law structure for the benefit of immigration practitioners and will go through the circumstances when immigration issues arise. |
| 6.50 pm – 7.20 pm | Allan Briddock – Blake Morgan LLP
As the immigration practitioner on the panel, Allan will give a whistle-stop history of how family issues have historically been dealt with in the immigration system and courts; how they are meant to be dealt with since the introduction of s.55; and how they are actually dealt with in practice. |
| 7.20 pm – 7.45 pm | Claire Colbert – Blake Morgan LLP
An important part of Claire’s practice is dealing with applications to take children out of the jurisdiction. Claire will go through the practical steps and difficulties in doing so. |
