Jacqueline Renton represented the mother in wardship proceedings in the High Court concerning her two children who had been wrongfully retained by the father in Russia after an agreed Christmas holiday.
The mother obtained various return orders and then applied through the courts in Moscow, Russia for some of those orders to be recognised and enforced pursuant to the 1996 Hague Convention. Yesterday the Moscow appellate court upheld the decision of the Moscow court at first instance to recognise and enforce the orders. As a result of the decision, it is anticipated that the mother will soon be reunited with the children. The case represents the first ever case in which the 1996 Hague Convention has been applied in Russia.
